1. WHO WE ARE

This Privacy Policy explains how 12khz, LLC, doing business as Sagapixel (“Sagapixel,” “we,” “us,” or “our”), collects, uses, discloses, and protects personal information through our website at https://sagapixel.com (the “Site”) and in the course of marketing our services.

Sagapixel is a digital marketing agency serving healthcare practices. This policy covers information we collect about visitors to our Site and prospective clients. It does not cover information we process on behalf of our clients under a separate services agreement. In that role we act as a service provider or processor, and our client’s own privacy policy governs. See Section 13.

2. INFORMATION WE COLLECT

We collect the following categories of personal information.

Information you give us directly. When you submit a contact form, request a proposal, schedule a call, apply for a job, or email or call us, we collect your name, business email address, phone number, company or practice name, budget range, and the contents of your message. If you become a client, we also collect billing contact details and account information.

Information collected automatically. When you visit the Site, our servers and analytics tools automatically collect your IP address, browser type and version, operating system, device type, referring URL, pages viewed, time spent on pages, links clicked, mouse movement and scrolling behavior, and the date and time of your visit. This is collected through cookies, pixels, log files, and similar technologies described in Section 4.

Information from third parties. We may receive information about you from advertising platforms, analytics providers, business data providers, and publicly available sources. For example, when you click one of our ads or when we verify a practice’s public business details.

We do not intentionally collect sensitive personal information from Site visitors, and we ask that you not include health information, Social Security numbers, financial account numbers, or patient information in messages you send us.

3. HOW WE USE INFORMATION

We use personal information to:

– Respond to your inquiry and provide the information you requested
– Send you marketing communications about our services, including email newsletters and case studies
– Schedule and conduct sales calls and consultations
– Prepare proposals and provide our services
– Operate, secure, maintain, and improve the Site
– Measure and improve the performance of our advertising and marketing
– Evaluate job applications
– Comply with legal obligations, enforce our agreements, and protect our rights

We do not use automated decision-making that produces legal or similarly significant effects about you.

4. COOKIES, PIXELS, AND ANALYTICS

We use cookies and similar technologies for three purposes: to make the Site work, to understand how it is used, and to measure and target advertising.

We currently use the following providers. Some of these set their own cookies and collect information directly.

Session recording and heatmaps. We use Microsoft Clarity to record how visitors interact with the Site, including mouse movement, clicks, scrolling, and the pages viewed during a visit. These recordings are used to understand and improve how the Site works. We configure this tool to mask text entered into form fields, and we do not use it to capture the contents of what you type into our forms.

Server-side tagging. Some of the measurement described above is performed server to server rather than in your browser. This does not change what we collect or who receives it, and the opt-out described in Section 8 applies to server-side measurement as well.

Most browsers let you refuse or delete cookies through their settings. Blocking cookies may affect how parts of the Site function. You can opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout, and you can manage interest-based advertising through the Digital Advertising Alliance at https://optout.aboutads.info and the Network Advertising Initiative at https://optout.networkadvertising.org.

Global Privacy Control. We honor the Global Privacy Control (GPC) and other recognized universal opt-out signals. If your browser or extension transmits a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information for targeted advertising from that browser.

5. HOW WE SHARE INFORMATION

We disclose personal information to:

Service providers who perform functions on our behalf, including CRM and marketing automation (HubSpot and LeadConnector), email delivery, analytics and session analysis (Google Analytics and Microsoft Clarity), hosting, scheduling, payment processing, and professional advisors. They are contractually limited to using the information to provide services to us.

Advertising and measurement partners, including Google, Meta, LinkedIn, Microsoft, X, Taboola, Paramount, OpenAI, and LiveIntent, as described in Sections 4 and 8.

Legal recipients, when required by law, subpoena, or court order; to enforce our agreements; or to protect the rights, safety, and property of Sagapixel, our clients, or others.

A successor entity in connection with a merger, acquisition, financing, or sale of assets.

We do not disclose your personal information to third parties for their own independent marketing purposes.

6. HOW LONG WE KEEP INFORMATION

We retain personal information for ten (10) years from the date we collect it or from your last interaction with us, whichever is later, after which we delete or de-identify it. This applies to inquiries, client records, contracts, billing records, and marketing contact information.

Two exceptions:

Website analytics and advertising data is retained according to each provider’s settings and defaults, which are generally shorter.

We may retain information longer than ten years where necessary to comply with a legal obligation, resolve a dispute, or establish or enforce our legal rights.

If you ask us to delete your information, we will do so before the end of this period, subject to the exceptions above. Marketing contact information is removed from active mailing lists as soon as you unsubscribe, regardless of this retention period.

7. HOW WE PROTECT INFORMATION

We maintain administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction. These include encryption in transit, access controls limiting employee access to what their role requires, multi-factor authentication on business systems, vendor security review, and workforce training.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we experience a breach affecting your personal information, we will notify you and any required regulators as the law requires.

8. SALE AND SHARING OF PERSONAL INFORMATION

We do not sell your personal information for money, and we do not upload your email address, phone number, or other contact information to advertising platforms to build audiences.

We do use retargeting. The advertising technologies described in Section 4 place cookies and pixels on your browser and share information about your visit, such as your device identifiers, IP address, and the pages you viewed, with advertising partners so that we can show you our ads on other sites and platforms. Under California and other state privacy laws, this activity is treated as a “sale” or “share” for targeted advertising and cross-context behavioral advertising, even though no money changes hands and we do not provide your contact details.

You can opt out. Use any of these:

Opting out stops the retargeting described above. It does not stop you from seeing our ads generally, and it does not affect the emails or calls covered by Section 10.

We do not knowingly sell or share the personal information of consumers under 16 years of age.

9. YOUR PRIVACY RIGHTS

Depending on where you live, you may have some or all of the following rights:

Know and access. Confirm whether we process your personal information and get a copy.

Correct. Have inaccurate personal information corrected.

Delete. Request deletion of personal information we hold about you.

Portability. Receive your information in a portable format.

Opt out. Opt out of targeted advertising, the sale or sharing of personal information, and profiling with legal or similarly significant effects.

Limit. Restrict the use of sensitive personal information.

Non-discrimination. We will not deny service, charge different prices, or provide a different quality of service because you exercised a privacy right.

These rights are available to residents of California, Colorado, Connecticut, Delaware, Florida, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Utah, and Virginia, among others, subject to each state’s specific law and exceptions.

How to submit a request. Email hr@sagapixel.com, call 856-701-7947, or write to the address in Section 1. Include enough information for us to locate your records and tell us what right you want to exercise.

Verification. We will ask you to verify your identity before acting, typically by confirming information we already have on file. We do not use verification information for any other purpose.

Authorized agents. You may use an authorized agent to submit a request. We may require written proof of authorization and separate verification of your identity.

Our response. We respond within 45 days. We may extend once by an additional 45 days where reasonably necessary, and will tell you if we do.

Appeals. If we decline your request, you may appeal by emailing hr@sagapixel.com with the subject line “Privacy Appeal” within 30 days. We will respond in writing within 45 days with our decision and the reasons for it. If we deny your appeal, we will provide a method for contacting your state attorney general to submit a complaint.

10. MARKETING COMMUNICATIONS

If you contact us or submit a form, we may email or call you about our services. Every marketing email includes an unsubscribe link, and we honor unsubscribe requests within 10 business days. You can also opt out at any time by emailing hr@sagapixel.com.

We will still send you transactional and relationship messages, such as responses to your inquiry, proposals, invoices, and service communications, after you opt out of marketing.

We maintain an internal do-not-call list. If you ask us not to call you, we will honor that request.

11. CHILDREN’S PRIVACY

The Site is intended for business audiences and is not directed to children. We do not knowingly collect personal information from anyone under 16. If you believe a child has provided us personal information, contact hr@sagapixel.com and we will delete it. We do not sell or share the personal information of consumers under 16 without the affirmative consent the law requires.

12. UNITED STATES ONLY

Sagapixel operates exclusively in the United States, and our services are offered only to healthcare practices located in the United States. The Site is intended for United States visitors, and we do not target, market to, or knowingly offer services to individuals in the European Economic Area, the United Kingdom, or other jurisdictions outside the United States.

All information we collect is stored and processed in the United States. If you access the Site from outside the United States, you do so on your own initiative and are responsible for compliance with your local laws.

13. OUR ROLE WHEN WORKING FOR CLIENTS

Sagapixel provides marketing services to healthcare practices. When we handle information on a client’s behalf, for example data in a client’s advertising accounts, analytics properties, or CRM, we act as that client’s service provider or processor, not as the controller of that information. We use it only to perform the services under our agreement with that client and do not sell it or use it for our own purposes. The client’s own privacy policy governs how that information is collected and used, and requests about it should be directed to the client.

Where we handle protected health information on behalf of a client that is a HIPAA covered entity, we do so under a Business Associate Agreement and in accordance with our obligations under HIPAA.

14. THIRD-PARTY LINKS

The Site contains links to third-party websites, including our clients’ sites and our social media profiles. We are not responsible for the privacy practices of those sites. Review their privacy policies before providing information to them.

15. CHANGES TO THIS POLICY

We may update this policy from time to time. When we do, we will revise the “Last Updated” date above. If we make material changes, we will provide additional notice, such as by posting a notice on the Site or emailing you. Your continued use of the Site after an update means you have read the revised policy.
